1、FOCUS取乍反不正当事法的守正興創新编者按近年束反不正當当競争规则的完善明加快，2 0 17 年、2 0 19 年反不正當競争法經歷雨次修法，2 0 2 2 年11月2 2 日，國家市場管總局公怖反不正當競争法（修订草案徽求意见稿）修法種種，示國家對於反不正當競争领域的密切關注。为此，本期聚焦组織相關文章，以回應理和實践熱點。上海交通大學護席教授、知識槿和競法研究院院長孔祥俊反不正當競争法補充保護知識産槿的有限性一文指出，知識産専門法奉行知識産槿法定原则，對於各類法定知識産槿行遵界清晰的强保護。反不正當競争法具有放性，可以不断適應知識產槿法益保護的新展，進行靈活的補充性知識產槿法益保護。専門

16、ts protection has received unprecedented attention from our legislation,law enforcement and judicature circles,and once became an important issue in Sino-foreign relations such as the China-Us economic and trade negotiations.Wang Yanfang,Professor atthe Intellectual Property School of East China Uni
17、versity of Political Science and Law,pointed out in her article Reconstruction of the Burden ofProof System for Infringement of Trade Secrets that the newly added Article 32“Burden of Proof of the Anti-Unfair Competition Law in 2019obviously implemented the results of and served the ongoing Sino-US
18、economic and trade negotiations at that time.It was a hasty revision to adaptto the changing circumstances,which was unbalanced in the system.The trade secret is a kind of right enjoyed by taking the coresponding meansof confidentiality,the generation of which is relatively independent.At the same t
19、ime,trade secrets are naturally secret and confidential,and are notdisclosed to the public.When disputes arise due to infringement,it is therefore ofen dificult to prove the existence oftrade secrets and infringing acts,which leads toprominent proofdifculy.Inviewofthis,when theAnti-UnfairCompetitionLwis goingtoberevised,thisarticle,aimngforbalaneand fairness,makes suggestions on the proper application and improvement of Article 32.
