5、urveillance, strengthen the supervision and administration of occupational health surveillance, and protect employees health and relevant rights and interests, these Measures are formulated in accordance with the Law of the Peoples Republic of China on the Prevention and Control of Occupational Dise

6、ases.第一条 为了规范用人单位职业健康监护工作,加强职业健康监护的监督管理,保护劳动者健康及其相关权益,根据中华人民共和国职业病防治法,制定本办法。Article 2 These Measures shall apply to employers surveillance over the occupational health of employees engaging in the operations with exposure to occupational disease hazards (hereinafter referred to as “employees”) and t

7、he supervision and administration on employers occupational health surveillance as conducted by work safety administrative departments.第二条 用人单位从事接触职业病危害作业的劳动者(以下简称劳动者)的职业健康监护和安全生产监督管理部门对其实施监督管理,适用本办法。Article 3 The term “occupational health surveillance” as mentioned in these Measures means the pre-j

8、ob, on-the-job, post-job and emergency occupational health examination of employees and the management of occupational health surveillance archives.第三条 本办法所称职业健康监护,是指劳动者上岗前、在岗期间、离岗时、应急的职业健康检查和职业健康监护档案管理。Article 4 Employers shall establish and improve the rules on the occupational health surveillance

9、 of employees, and implement occupational health surveillance pursuant to law.第四条 用人单位应当建立、健全劳动者职业健康监护制度,依法落实职业健康监护工作。Article 5 Employers shall accept the supervision and inspection on their occupational health surveillance as conducted by work safety administrative departments pursuant to law, and

10、provide the relevant documents and materials.第五条 用人单位应当接受安全生产监督管理部门依法对其职业健康监护工作的监督检查,并提供有关文件和资料。Article 6 All entities and individuals shall be entitled to make tip-offs or reports to the work safety administrative departments regarding any employers violation of these Measures.第六条 对用人单位违反本办法的行为,任何单

11、位和个人均有权向安全生产监督管理部门举报或者报告。Chapter II Employers Responsibilities第二章 用人单位的职责Article 7 Employers shall be the main body responsible for occupational health surveillance, and their major persons in charge shall take overall responsibility for their respective occupational health surveillance.Employers sh

12、all, in accordance with these Measures, the Technical Specifications for Occupational Health Surveillance (GBZ188), the Technical Specifications for Occupational Health Surveillance for Workers under Radiation Environment (GBZ235) and other national occupational health standards, formulate and carry

13、 out their respective annual occupational health examination plans, and guarantee the required special funds.第七条 用人单位是职业健康监护工作的责任主体,其主要负责人对本单位职业健康监护工作全面负责。用人单位应当依照本办法以及职业健康监护技术规范(GBZ188)、放射工作人员职业健康监护技术规范(GBZ235)等国家职业卫生标准的要求,制定、落实本单位职业健康检查年度计划,并保证所需要的专项经费。Article 8 Employers shall organize employees

14、to undergo occupational health examinations, and assume the expenses for the occupational health examinations.The time for employees to undergo occupational health examinations shall be deemed as working time.第八条 用人单位应当组织劳动者进行职业健康检查,并承担职业健康检查费用。劳动者接受职业健康检查应当视同正常出勤。Article 9 Employers shall select me

15、dical health institutions approved by the health administrative departments of the peoples governments at and above the provincial level to assume the occupational health examinations, and ensure the truthfulness of identities of employees who undergo occupational health examinations.第九条 用人单位应当选择由省级

16、以上人民政府卫生行政部门批准的医疗卫生机构承担职业健康检查工作,并确保参加职业健康检查的劳动者身份的真实性。Article 10 Where an employer entrusts an occupational health examination institution to examine the occupational health of employees engaging in operations with exposure to occupational disease hazards, it shall truthfully provide the following d

17、ocuments and materials:1. the employers basic information;2. types of occupational disease hazardous factors exist in work places and the list of personnel being exposed to such hazardous factors; and3. regular testing and evaluation results on occupational disease hazardous factors.第十条 用人单位在委托职业健康检

18、查机构对从事接触职业病危害作业的劳动者进行职业健康检查时,应当如实提供下列文件、资料:(一)用人单位的基本情况;(二)工作场所职业病危害因素种类及其接触人员名册;(三)职业病危害因素定期检测、评价结果。Article 11 Employers shall organize pre-job occupational health examinations for the following employees:1. newly-recruited employees who are to engage in operations with exposure to occupational dis

19、ease hazards, including employees transferred to such positions; and2. employees who are to engage in the operations with special health requirements.第十一条 用人单位应当对下列劳动者进行上岗前的职业健康检查:(一) 拟从事接触职业病危害作业的新录用劳动者,包括转岗到该作业岗位的劳动者;(二)拟从事有特殊健康要求作业的劳动者。Article 12 Employers shall not assign employees who have not

20、undergone pre-job occupational health examinations to conduct operations with exposure to occupational disease hazards; and shall not assign employees with occupational contraindications to operation positions with these contraindications.Employers shall not assign underage employees to conduct oper

21、ations with exposure to occupational disease hazards; and shall not assign female employees who are pregnant or lactating to conduct operations causing hazards to them and their fetuses or babies.第十二条 用人单位不得安排未经上岗前职业健康检查的劳动者从事接触职业病危害的作业,不得安排有职业禁忌的劳动者从事其所禁忌的作业。用人单位不得安排未成年工从事接触职业病危害的作业,不得安排孕期、哺乳期的女职工从

22、事对本人和胎儿、婴儿有危害的作业。Article 13 Employers shall, in light of occupational disease hazardous factors which employees are exposed to, regularly arrange on-the-job occupational health examinations for employees.For on-the-job occupational health examinations, employers shall, in accordance with the provisi

23、ons and requirements of the Technical Specifications for Occupational Health Surveillance (GBZ188) and other national occupational health standards, determine the items and intervals of examinations for employees being exposed to occupational disease hazards. Where it is necessary to conduct reexami

24、nations, employers shall increase the corresponding examination items in accordance with the reexamination requirements.第十三条 用人单位应当根据劳动者所接触的职业病危害因素,定期安排劳动者进行在岗期间的职业健康检查。对在岗期间的职业健康检查,用人单位应当按照职业健康监护技术规范(GBZ188)等国家职业卫生标准的规定和要求,确定接触职业病危害的劳动者的检查项目和检查周期。需要复查的,应当根据复查要求增加相应的检查项目。Article 14 Under any of the

25、following circumstances, the employer shall immediately organize relevant employees to undergo emergency occupational health examinations:1. Any employee being exposed to occupational disease hazardous factors has discomfort related to the said hazardous factors to which he or she is exposed during

26、operations; or2. Any employee suffers from acute occupational poisoning hazards or has occupational poisoning symptoms.第十四条 出现下列情况之一的,用人单位应当立即组织有关劳动者进行应急职业健康检查:(一)接触职业病危害因素的劳动者在作业过程中出现与所接触职业病危害因素相关的不适症状的;(二)劳动者受到急性职业中毒危害或者出现职业中毒症状的。Article 15 For employees who are to leave the operations or position

27、s with occupational disease hazards, the employer shall, within 30 days before the employees leave their positions, organize post-job occupational health examinations for the employees. On-the-job occupational health examinations undergone within 90 days before the employees leave their positions ma

28、y be regarded as the post-job occupational health examination.Employers shall not rescind or terminate labor contacts with employees who have not undergone post-job occupational health examinations.第十五条 对准备脱离所从事的职业病危害作业或者岗位的劳动者,用人单位应当在劳动者离岗前30日内组织劳动者进行离岗时的职业健康检查。劳动者离岗前90日内的在岗期间的职业健康检查可以视为离岗时的职业健康检查。

29、用人单位对未进行离岗时职业健康检查的劳动者,不得解除或者终止与其订立的劳动合同。Article 16 Employers shall, in a timely manner, truthfully inform employees of the occupational health examination results and suggestions from the occupational health examination institutions in writing.第十六条 用人单位应当及时将职业健康检查结果及职业健康检查机构的建议以书面形式如实告知劳动者。Article 1

30、7 Employers shall, in accordance with the occupational health examination reports, take the following measures:1. transfer or temporarily discharge employees with occupational contraindications from their original work positions;2. appropriately relocate employees who suffer from job-related health

31、injuries;3. arrange for reexaminations and medical observations for employees who require reexaminations in accordance with the time as set down by occupational health examination institutions;4. arrange for medical observations or occupational disease diagnosis for patients suspected of having occu

32、pational diseases by taking into consideration the suggestions provided by occupational health examination institutions; and5. For positions with occupational disease hazards, immediately improve labor conditions, improve anti-occupational diseases facilities, and provide employees with occupational

33、 disease protection items that are in compliance with national standards.第十七条 用人单位应当根据职业健康检查报告,采取下列措施:(一)对有职业禁忌的劳动者,调离或者暂时脱离原工作岗位;(二)对健康损害可能与所从事的职业相关的劳动者,进行妥善安置;(三)对需要复查的劳动者,按照职业健康检查机构要求的时间安排复查和医学观察;(四)对疑似职业病病人,按照职业健康检查机构的建议安排其进行医学观察或者职业病诊断;(五)对存在职业病危害的岗位,立即改善劳动条件,完善职业病防护设施,为劳动者配备符合国家标准的职业病危害防护用品。Ar

34、ticle 18 In the case of a new occupational disease (occupational poisoning) or two or more suspected occupational diseases (occupational poisoning) occurring during occupational health surveillance, the employer shall report to the local work safety administrative department in a timely manner.第十八条

35、职业健康监护中出现新发生职业病(职业中毒)或者两例以上疑似职业病(职业中毒)的,用人单位应当及时向所在地安全生产监督管理部门报告。Article 19 Employers shall establish occupational health surveillance archives for employees, and appropriately keep such archives in accordance with the relevant provisions. Occupational health surveillance archives shall cover:1. emp

36、loyees name, gender, age, place of birth, marriage, educational background, hobbies and other information;2. employees occupational history, past medical history and history of exposure to occupational disease hazards;3. past occupational health examination results and handling information;4. materi

37、als concerning the diagnosis and treatment of occupational diseases; and5. other relevant materials that need to be included in the occupational health surveillance archives.第十九条 用人单位应当为劳动者个人建立职业健康监护档案,并按照有关规定妥善保存。职业健康监护档案包括下列内容:(一)劳动者姓名、性别、年龄、籍贯、婚姻、文化程度、嗜好等情况;(二)劳动者职业史、既往病史和职业病危害接触史;(三)历次职业健康检查结果及处

38、理情况;(四)职业病诊疗资料;(五)需要存入职业健康监护档案的其他有关资料。Article 20 Work safety administrative law enforcement personnel, employees or their close relatives and agents authorized by employees shall be entitled to consult and copy employees occupational health surveillance archives.Employees leaving an employer shall b

39、e entitled to request a copy of their own occupational health surveillance archives, and the employer shall provide a copy of such archives free of charge and in a truthful manner, and sign and seal the copy provided.第二十条 安全生产行政执法人员、劳动者或者其近亲属、劳动者委托的代理人有权查阅、复印劳动者的职业健康监护档案。劳动者离开用人单位时,有权索取本人职业健康监护档案复印件

40、,用人单位应当如实、无偿提供,并在所提供的复印件上签章。Article 21 An employer undergoing business split or merger, dissolution, or bankruptcy shall organize occupational health examinations for employees and appropriately relocate patients with occupational diseases in accordance with the relevant provisions of the state; and

41、 their occupational health surveillance archives shall be transferred for safekeeping in accordance with the relevant provisions of the state.第二十一条 用人单位发生分立、合并、解散、破产等情形时,应当对劳动者进行职业健康检查,并依照国家有关规定妥善安置职业病病人;其职业健康监护档案应当依照国家有关规定实施移交保管。Chapter III Supervision and Administration第三章 监督管理Article 22 Work safe

42、ty administrative departments shall, pursuant to law, supervise and inspect employers implementation of the laws, administrative regulations, rules and standards on occupational health surveillance, and mainly supervise and inspect:1. the establishment of occupational health surveillance rules;2. th

43、e formulation of occupational health surveillance plans and the guarantee of special funds;3. the provision of true materials required for occupational health examinations;4. the pre-job, on-the-job, post-job and emergency occupational health examinations of employees;5. the fulfillment of obligatio

44、ns to notify employees of occupational health examination results and suggestions;6. the adoption of measures according to occupational health examination reports;7. the reporting of occupational diseases and suspected occupational diseases;8. the establishment and management of employees occupation

45、al health surveillance archives;9. the provision of copies of occupational health surveillance archives free of charge and in a truthful manner to employees leaving the employers; and10. other information that shall be subject to supervision and inspection pursuant to law.第二十二条 安全生产监督管理部门应当依法对用人单位落实

46、有关职业健康监护的法律、法规、规章和标准的情况进行监督检查,重点监督检查下列内容:(一)职业健康监护制度建立情况;(二)职业健康监护计划制定和专项经费落实情况;(三)如实提供职业健康检查所需资料情况;(四)劳动者上岗前、在岗期间、离岗时、应急职业健康检查情况;(五)对职业健康检查结果及建议,向劳动者履行告知义务情况;(六)针对职业健康检查报告采取措施情况;(七)报告职业病、疑似职业病情况;(八)劳动者职业健康监护档案建立及管理情况;(九)为离开用人单位的劳动者如实、无偿提供本人职业健康监护档案复印件情况;(十)依法应当监督检查的其他情况。Article 23 Work safety admin

47、istrative departments shall strengthen occupational health knowledge training for administrative law enforcement personnel, and improve their business capabilities.第二十三条 安全生产监督管理部门应当加强行政执法人员职业健康知识培训,提高行政执法人员的业务素质。Article 24 Work safety administrative law enforcement personnel shall produce their valid law enforcement credentials when performing their supervision and inspection duties pursuant to law.Work safety administrative law enforcement personnel shall be devoted to their duties, be impartial in law enforcement, and strictly abide by law enforcement rules; and keep confidential the invo
