4、七年四月九日生产安全事故报告和调查处理条例Chapter I General Provisions第一章 总则Article 1 In order to regulate the reporting, investigation and disposition of production safety accidents, implement the system of investigating liabilities for production safety accidents, and prevent and reduce production safety accidents, th
5、ese regulations have been made in accordance with the Law on Safe Production of the Peoples Republic of China and relevant laws.第一条 为了规范生产安全事故的报告和调查处理，落实生产安全事故责任追究制度，防止和减少生产安全事故，根据中华人民共和国安全生产法和有关法律，制定本条例。Article 2 These regulations shall apply to the reporting, investigation and disposition of the p
6、roduction safety accidents that have caused casualty or direct economic losses arising out of the production or business operation; these regulations shall not apply to the reporting, investigation and disposition of the environmental pollution accidents, nuclear facility accidents and accidents ari
7、sing out of scientific research and production for national defense.第二条 生产经营活动中发生的造成人身伤亡或者直接经济损失的生产安全事故的报告和调查处理，适用本条例；环境污染事故、核设施事故、国防科研生产事故的报告和调查处理不适用本条例。Article 3 By the casualty or direct economic losses caused in a production safety accident (hereafter “accident”), the accidents shall be generall
8、y graded as follows:(a) Especially serious accident refers to an accident that has caused the deaths of at least 30 persons, serious injuries to at least 100 persons (including acute industrial poisoning), or direct economic losses of at least RMB 100 million yuan;(b) Serious accident refers to an a
9、ccident that has caused the deaths of at least 10 but less than 30 persons, serious injuries to at least 50 but less than 100 persons, or direct economic losses of at least RMB 50 million yuan but less than RMB 100 million yuan;(c) Large accident refers to an accident that has caused the deaths of a
10、t least 3 but less than 10 persons, serious injuries to at least 10 but less than 50 persons, or direct economic losses of at least RMB 10 million yuan but less than RMB 50 million yuan; and(d) Ordinary accident refers to an accident that has caused the deaths of less than 3 persons, serious injurie
11、s to less than 10 persons, or direct economic losses of less than RMB 10 million yuan.The Administration of Work Safety of the State Council may make supplementary rules on the grading of accidents in conjunction with the relevant authorities of the State Council.The “at least” mentioned in the prec
12、eding paragraph shall include the number itself, and the “less than” shall not.第三条 根据生产安全事故（以下简称事故）造成的人员伤亡或者直接经济损失，事故一般分为以下等级：（一）特别重大事故，是指造成30人以上死亡，或者100人以上重伤（包括急性工业中毒，下同），或者1亿元以上直接经济损失的事故；（二）重大事故，是指造成10人以上30人以下死亡，或者50人以上100人以下重伤，或者5000万元以上1亿元以下直接经济损失的事故；（三）较大事故，是指造成3人以上10人以下死亡，或者10人以上50人以下重伤，或者1000
13、万元以上5000万元以下直接经济损失的事故；（四）一般事故，是指造成3人以下死亡，或者10人以下重伤，或者1000万元以下直接经济损失的事故。国务院安全生产监督管理部门可以会同国务院有关部门，制定事故等级划分的补充性规定。本条第一款所称的“以上”包括本数，所称的“以下”不包括本数。（相关资料:部门规章1篇地方法规5篇）Article 4 The accident reporting shall be timely, accurate and complete, and any entity or individual shall not delay, omit, falsify or conc
14、eal the reporting. The investigation and disposition of an accident shall observe the principle of seeking truth from facts and respect for science. The process of, causes for and damage by the accident shall be ascertained timely and accurately, the nature of the accident shall be clarified, the li
15、ability for the accident shall be determined, the lessons from the accident shall be summarized, the measures for rectification shall be proposed, and the liabilities of those liable for the accident shall be investigated according to law.第四条 事故报告应当及时、准确、完整，任何单位和个人对事故不得迟报、漏报、谎报或者瞒报。事故调查处理应当坚持实事求是、尊重
16、科学的原则，及时、准确地查清事故经过、事故原因和事故损失，查明事故性质，认定事故责任，总结事故教训，提出整改措施，并对事故责任者依法追究责任。（相关资料:地方法规1篇）Article 5 The peoples governments at or above the county level shall strictly discharge their functions, and timely and accurately complete the investigation and disposition of accidents in accordance with these regu
17、lations.The relevant local peoples government at the place of occurrence of an accident shall support and assist the superior peoples government or relevant authorities in the investigation and disposition of accidents, and provide necessary conveniences.The authorities and entities participating in
18、 the investigation and disposition of an accident shall assist each other to improve the working efficiency of investigation and disposition.第五条 县级以上人民政府应当依照本条例的规定，严格履行职责，及时、准确地完成事故调查处理工作。事故发生地有关地方人民政府应当支持、配合上级人民政府或者有关部门的事故调查处理工作，并提供必要的便利条件。参加事故调查处理的部门和单位应当互相配合，提高事故调查处理工作的效率。Article 6 The trade unio
19、n shall participate in the investigation and disposition of accidents according to law, and shall have the right to offer opinions on disposition to the relevant authorities.第六条 工会依法参加事故调查处理，有权向有关部门提出处理意见。Article 7 Any entity or individual shall not obstruct or interfere with the reporting and legal
20、 investigation and disposition of an accident.第七条 任何单位和个人不得阻挠和干涉对事故的报告和依法调查处理。Article 8 Any entity or individual shall have the right to inform the work safety authority, supervisory authorities or other relevant authorities of any violation in the reporting, investigation and disposition of an acci
21、dent, and the authorities receiving such information shall timely deal with it according to law.第八条 对事故报告和调查处理中的违法行为，任何单位和个人有权向安全生产监督管理部门、监察机关或者其他有关部门举报，接到举报的部门应当依法及时处理。Chapter II Accident Reporting第二章 事故报告Article 9 After the occurrence of an accident, the relevant on-site personnel in the accident
22、shall immediately report it to the person in charge of their entity; the person in charge of their entity shall report it to the work safety authority and relevant authorities responsible for work safety of the peoples government at or above the county level at the place of occurrence of the acciden
23、t within 1 hour after receiving the report.In case of emergency, the relevant on-site personnel in the accident may directly report it to the work safety authority and relevant authorities responsible for work safety of the peoples government at or above the county level at the place of occurrence o
24、f the accident.第九条 事故发生后，事故现场有关人员应当立即向本单位负责人报告；单位负责人接到报告后，应当于1小时内向事故发生地县级以上人民政府安全生产监督管理部门和负有安全生产监督管理职责的有关部门报告。情况紧急时，事故现场有关人员可以直接向事故发生地县级以上人民政府安全生产监督管理部门和负有安全生产监督管理职责的有关部门报告。（相关资料:地方法规1篇）Article 10 After receiving an accident report, the work safety authority and relevant authorities responsible for
25、work safety of the peoples government shall report the accident to their superior authorities, and notify the public security organ, administrative authority on labor security, trade union and peoples procuratorate, as required below:(a) An especially serious accident or serious accident shall be re
26、ported level by level to the work safety authority and relevant authorities responsible for work safety of the State Council;(b) A large accident shall be reported level by level to the work safety authority and relevant authorities responsible for work safety of the peoples government of a province
27、, autonomous region or municipality directly under the Central Government; and(c) An ordinary accident shall be reported to the work safety authority and relevant authorities responsible for work safety of the peoples government of a municipality with districts.While reporting an accident pursuant t
28、o the preceding paragraph, the work safety authority and relevant authorities responsible for work safety shall report it to the peoples government at the same level. The work safety authority and relevant authorities responsible for work safety of the peoples government of the State Council and the
29、 provincial peoples government after receiving a report of an especially serious or serious accident shall immediately report it to the State Council.When necessary, the work safety authority and relevant authorities responsible for work safety may report the accident by bypassing the immediate leve
30、l or levels.第十条 安全生产监督管理部门和负有安全生产监督管理职责的有关部门接到事故报告后，应当依照下列规定上报事故情况，并通知公安机关、劳动保障行政部门、工会和人民检察院：（一）特别重大事故、重大事故逐级上报至国务院安全生产监督管理部门和负有安全生产监督管理职责的有关部门；（二）较大事故逐级上报至省、自治区、直辖市人民政府安全生产监督管理部门和负有安全生产监督管理职责的有关部门；（三）一般事故上报至设区的市级人民政府安全生产监督管理部门和负有安全生产监督管理职责的有关部门。安全生产监督管理部门和负有安全生产监督管理职责的有关部门依照前款规定上报事故情况，应当同时报告本级人民政府。
31、国务院安全生产监督管理部门和负有安全生产监督管理职责的有关部门以及省级人民政府接到发生特别重大事故、重大事故的报告后，应当立即报告国务院。必要时，安全生产监督管理部门和负有安全生产监督管理职责的有关部门可以越级上报事故情况。（相关资料:地方法规2篇）Article 11 Where the work safety authority and relevant authorities responsible for work safety report an accident level by level, the time for reporting at each level shall n
32、ot exceed 2 hours.第十一条 安全生产监督管理部门和负有安全生产监督管理职责的有关部门逐级上报事故情况，每级上报的时间不得超过2小时。Article 12 An accident report shall include:(a) Introduction to the entity of occurrence of the accident;(b) Time and place of occurrence of the accident and information on the site of the accident;(c) Brief process of the ac
33、cident;(d) Number of casualties or likely casualties (including the missing persons) and initial estimate of direct economic losses as a result of the accident;(e) Measures already taken; and(f) Other information that should be reported.第十二条 报告事故应当包括下列内容：（一）事故发生单位概况；（二）事故发生的时间、地点以及事故现场情况；（三）事故的简要经过；
34、（四）事故已经造成或者可能造成的伤亡人数（包括下落不明的人数）和初步估计的直接经济损失；（五）已经采取的措施；（六）其他应当报告的情况。Article 13 Any new situation arising after the reporting of an accident shall be reported timely in addition.Any change of the number of casualties as a result of an accident within 30 days as of the date of occurrence of the accide
35、nt shall be reported timely in addition. Any change of the number of casualties as a result of a road traffic or fire accident within 7 days as of the date of occurrence of the accident shall be reported timely in addition.第十三条 事故报告后出现新情况的，应当及时补报。自事故发生之日起30日内，事故造成的伤亡人数发生变化的，应当及时补报。道路交通事故、火灾事故自发生之日起7
36、日内，事故造成的伤亡人数发生变化的，应当及时补报。Article 14 After receiving an accident report, the person in charge of the entity of occurrence of the accident shall immediately start up the relevant plan on the emergency response to accident, or take effective measures to organize rescue, avoid expansion of the accident
37、and reduce the casualties as well as property damage.第十四条 事故发生单位负责人接到事故报告后，应当立即启动事故相应应急预案，或者采取有效措施，组织抢救，防止事故扩大，减少人员伤亡和财产损失。（相关资料:地方法规1篇）Article 15 After the relevant local peoples government, work safety authority and relevant authorities responsible for work safety receive an accident report, the p
38、ersons in charge of them shall reach the accident site immediately to organize accident rescue.第十五条 事故发生地有关地方人民政府、安全生产监督管理部门和负有安全生产监督管理职责的有关部门接到事故报告后，其负责人应当立即赶赴事故现场，组织事故救援。Article 16 After an accident occurs, the relevant entity and personnel shall properly protect the accident site and relevant evi
39、dence, and any entity or individual shall not spoil the accident site or destroy relevant evidence.Where any object on the accident site needs to be dislocated for reasons of rescuing persons, prevention of accident expansion, traffic direction and control, etc., a sign shall be indicated, a site di
40、agram shall be drawn and a written record shall be made, to properly save the major marks and material evidence on the site.第十六条 事故发生后，有关单位和人员应当妥善保护事故现场以及相关证据，任何单位和个人不得破坏事故现场、毁灭相关证据。因抢救人员、防止事故扩大以及疏通交通等原因，需要移动事故现场物件的，应当做出标志，绘制现场简图并做出书面记录，妥善保存现场重要痕迹、物证。（相关资料:地方法规1篇）Article 17 Based on the accident sit
41、uations, the public security organ at the place of occurrence of an accident shall legally file a case for criminal investigation, and take compulsory measures and investigative measures, if a crime is suspected. Where the suspect is at large, the public security organ shall pursue and put the suspe
42、ct under custody promptly.第十七条 事故发生地公安机关根据事故的情况，对涉嫌犯罪的，应当依法立案侦查，采取强制措施和侦查措施。犯罪嫌疑人逃匿的，公安机关应当迅速追捕归案。（相关资料:地方法规1篇）Article 18 The work safety authority and relevant authorities responsible for work safety shall establish a shift system, and make available to the public the telephone number for the shift
43、 system, to accept the accident report and information.第十八条 安全生产监督管理部门和负有安全生产监督管理职责的有关部门应当建立值班制度，并向社会公布值班电话，受理事故报告和举报。Chapter III Accident Investigation第三章 事故调查Article 19 An especially serious accident shall be investigated by an accident investigative team organized by the State Council or the rele
44、vant authorities empowered by the State Council.A serious accident, large accident or ordinary accident shall be investigated by the provincial peoples government, peoples government of a municipality with districts or peoples government at the county level respectively of the place of accident. The
45、 provincial peoples government, peoples government of a municipality with districts or peoples government at the county level may directly organize an accident investigative team to investigate, or empower or entrust the relevant authorities to organize an accident investigative team to investigate.
46、The peoples government at the county level may also entrust the entity of occurrence of the accident to organize an accident investigative team to investigate, if the accident is an ordinary accident without casualty.第十九条 特别重大事故由国务院或者国务院授权有关部门组织事故调查组进行调查。重大事故、较大事故、一般事故分别由事故发生地省级人民政府、设区的市级人民政府、县级人民政府
47、负责调查。省级人民政府、设区的市级人民政府、县级人民政府可以直接组织事故调查组进行调查，也可以授权或者委托有关部门组织事故调查组进行调查。未造成人员伤亡的一般事故，县级人民政府也可以委托事故发生单位组织事故调查组进行调查。Article 20 A superior peoples government, when deeming necessary, may investigate an accident which the inferior peoples government is responsible for investigation.Where the accident grade
48、 changes as the number of casualties as a result of the accident changes within 30 days as of the date of occurrence of the accident (or within 7 days as of the date of occurrence of a road traffic or fire accident), and thus the superior peoples government shall be responsible for the investigation of it in accordance with these regulations, the superior peoples go
