8、管理办法Chapter I General Provisions第一章 总则Article 1 These Measures are formulated in accordance with the “Law of the Peoples Republic of China on Energy Conservation”, the “Product Quality Law of the Peoples Republic of China”, the “Regulation of the Peoples Republic of China on Certification and Accred
9、itation” so as to strengthen the administration of energy conservation, propel the progress of energy conservation technologies, and improve energy efficiency.第一条 为加强节能管理，推动节能技术进步，提高能源效率，依据中华人民共和国节约能源法、中华人民共和国产品质量法、中华人民共和国认证认可条例，制定本办法。Article 2 Energy efficiency label as mentioned in these Measures
10、shall mean a kind of information label indicating the energy efficiency grade and other performance indices of energy consuming products, which belongs to product conformity labels.第二条 本办法所称能源效率标识，是指表示用能产品能源效率等级等性能指标的一种信息标识，属于产品符合性标志的范畴。Article 3 The State practices a uniform energy efficiency label
11、 system to the widely used energy consuming products with great potential in energy conservation. The State formulates and promulgates the “Catalogue of the Peoples Republic of China on the Products To Be Attached with Energy Efficiency Labels” (hereinafter referred to as the “Catalogue”), and deter
12、mines uniformly applicable product energy efficiency standards, implementation rules, specimen and specifications of energy efficiency labels.第三条 国家对节能潜力大、使用面广的用能产品实行统一的能源效率标识制度。国家制定并公布中华人民共和国实行能源效率标识的产品目录（以下简称目录），确定统一适用的产品能效标准、实施规则、能源效率标识样式和规格。Article 4 For any product listed into the “Catalogue”,
13、the uniform energy efficiency label shall be indicated on an eye-catching position of the product or its smallest packing, and shall be stated in the instructions of this product.第四条 凡列入目录的产品，应当在产品或者产品最小包装的明显部位标注统一的能源效率标识，并在产品说明书中说明。Article 5 The manufacturer or importer of a product listed into the
14、 “Catalogue” shall, after using the energy efficiency label, submit the energy efficiency label and other relevant information to the institution authorized by the State Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as the SAQSIQ) and the National Developm
15、ent and Reform Commission (hereinafter referred to as the NDRC) (the said institution is hereinafter referred to as the authorized institution) for archival filing.第五条 列入目录的产品的生产者或进口商应当在使用能源效率标识后，向国家质量监督检验检疫总局（以下简称国家质检总局）和国家发展和改革委员会（以下简称国家发展改革委）授权的机构（以下简称授权机构）备案能源效率标识及相关信息。Article 6 The NDRC, the SA
16、QSIQ and the National Certification and Accreditation Administration (hereinafter referred to as the CNCA) shall take charge of establishing the energy efficiency label system and organizing the implementation thereof.The energy conservation administrative department of the local peoples government
17、at each level (hereinafter referred to as the local energy conservation administrative department), the local quality and technical supervision department and the entry and exit inspection and quarantine institution at each level (hereinafter referred to as the local quality inspection department) s
18、hall, within scope of their duties, conduct supervision and inspection on the use of energy efficiency labels within the jurisdiction.第六条 国家发展改革委、国家质检总局和国家认证认可监督管理委员会（以下简称国家认监委）负责能源效率标识制度的建立并组织实施。地方各级人民政府节能管理部门（以下简称地方节能管理部门）、地方质量技术监督部门和各级出入境检验检疫机构（以下简称地方质检部门），在各自的职责范围内对所辖区域内能源效率标识的使用实施监督检查。（相关资料:部门规
19、章1篇地方法规5篇）Chapter II Implementation of Energy Efficiency Labels第二章 能源效率标识的实施Article 7 The NDRC, the SAQSIQ and the CNCA shall formulate the “Catalogue” and the implementation rules. The NDRC and the CNCA shall formulate and promulgate the uniform specimen and specifications of energy efficiency labe
20、ls for the applicable products.第七条 国家发展改革委、国家质检总局和国家认监委制定目录和实施规则。国家发展改革委和国家认监委制定和公布适用产品的统一的能源效率标识样式和规格。Article 8 The name of the energy efficiency label is China Energy Label. The energy efficiency label shall include the following basic contents:(1) name or shortened name of the manufacturer;(2) sp
21、ecifications and type of the product;(3) energy efficiency grade;(4) energy consumption; and(5) number of the applicable national standards for energy efficiency.第八条 能源效率标识的名称为“中国能效标识”（英文名称为ChinaEnergyLabel），能源效率标识应当包括以下基本内容：（一）生产者名称或者简称；（二）产品规格型号；（三）能源效率等级；（四）能源消耗量；（五）执行的能源效率国家标准编号。Article 9 The ma
22、nufacturer or importer of a product listed into the “Catalogue” may make the test either with its own testing capacity or by entrusting a test institution accredited by an accreditation institution determined by the State, and shall, according to the national standards for energy efficiency, determi
23、ne the energy efficiency grade of the product.For a manufacturer or importer who determines the energy efficiency grade with its own testing capacity, its testing resource shall have the basic capacity to make tests according to the national standards for energy efficiency. The State encourages the
24、laboratories of such manufacturers or importers to obtain the national accreditation issued by the accreditation institutions.第九条 列入目录的产品的生产者或进口商，可以利用自身的检测能力，也可以委托国家确定的认可机构认可的检测机构进行检测，并依据能源效率国家标准，确定产品能源效率等级。利用自身检测能力确定能源效率等级的生产者或进口商，其检测资源应当具备按照能源效率国家标准进行检测的基本能力，国家鼓励其实验室取得认可机构的国家认可。Article 10 A manufa
25、cturer or importer shall print and use energy efficiency labels according to the specimen and specifications uniformly prescribed by the State on energy efficiency labels, and the provisions on indication, as well.The energy efficiency labels used in the packs, instructions and advertisements of a p
26、roduct may be magnified or minified in proportion, and shall be clear enough to be identified.第十条 生产者或进口商应当根据国家统一规定的能源效率标识样式、规格以及标注规定，印制和使用能源效率标识。在产品包装物、说明书以及广告宣传中使用的能源效率标识，可按比例放大或者缩小，并清晰可辨。Article 11 A manufacturer or importer shall, within 30 days as of using an energy efficiency label, submit the
27、 label to the authorized institution for archival filing, and submit the following materials by letter, telegraph, telex, fax, e-mail or other means:(1) a photocopy of the manufacturers business license or registration certificate; a counterpart of the relevant contract concluded between the importe
28、r and the overseas manufacturer;(2) a test report on the energy efficiency of the product;(3) a specimen of the energy efficiency label;(4) the initial date of use and other relevant materials; and(5) the entrustment documents, etc. of the manufacturer or importer in the event that the materials for
29、 archival filing are submitted by a proxy.The abovementioned materials shall be authentic, accurate and entire.The materials in a foreign language shall be attached with the Chinese translation, and the Chinese translation shall prevail.第十一条 生产者或进口商应当自使用能源效率标识之日起30日内，向授权机构备案，可以通过信函、电报、电传、传真、电子邮件等方式提
30、交以下材料：（一）生产者营业执照或者登记注册证明复印件；进口商与境外生产者订立的相关合同副本；（二）产品能源效率检测报告；（三）能源效率标识样本；（四）初始使用日期等其他有关材料；（五）由代理人提交备案材料时，应有生产者或进口商的委托代理文件等。上述材料应当真实、准确、完整。外文材料应当附有中文译本，并以中文文本为准。Article 12 Where the contents of an energy efficiency label is changed, it shall be submitted for a second time for archival filing.第十二条 能源效
31、率标识内容发生变化，应当重新备案。Article 13 In case any dispute over the energy efficiency index of a product arises, the enterprise shall entrust a legally certified third party test institution or a third party test institution accredited by an accreditation institution to make a re-test, and the test results sha
32、ll be deemed as the basis for dispute settlement.第十三条 对产品的能源效率指标发生争议时，企业应当委托经依法认定或者认可机构认可的第三方检测机构重新进行检测，并以其检测结果为准。Article 14 An authorized institution shall announce the archived information at regular intervals, and shall verify the energy efficiency labels used by manufacturers and importers.No fe
33、e shall be charged for the archival filing of an energy efficiency label.第十四条 授权机构应当定期公告备案信息，并对生产者和进口商使用的能源效率标识进行核验。能源效率标识备案不收取费用。Chapter III Supervision and Administration第三章 监督管理Article 15 A manufacturer or importer shall be responsible for the accuracy of the information on the energy efficiency
34、label it uses, and shall not forge or imitate any energy efficiency label.第十五条 生产者和进口商应当对其使用的能源效率标识信息准确性负责，不得伪造或冒用能源效率标识。Article 16 No seller shall sell products on which the energy efficiency label ought to be indicated but is not indicated, nor shall it forge or imitate any energy efficiency label
35、.第十六条 销售者不得销售应当标注但未标注能源效率标识的产品，不得伪造或冒用能源效率标识。Article 17 A test institution accredited by an accreditation institution shall, when entrusted by a manufacturer or importer to make a test, be objective and impartial, guarantee the accuracy of the test results, bear corresponding legal liabilities, and
36、maintain commercial secrets for the tested products.第十七条 认可机构认可的检测机构接受生产者或进口商的委托进行检测，应当客观、公正，保证检测结果的准确，承担相应的法律责任，并保守受检产品的商业秘密。Article 18 No entity or individual may make use of energy efficiency labels to falsely publicize its/his energy consuming products, or to mislead consumers.第十八条 任何单位和个人不得利用能源
37、效率标识对其用能产品进行虚假宣传，误导消费者。Article 19 The SAQSIQ and the NDRC shall, upon their respective duties, inspect the products listed into the “Catalogue”, and verify the information on energy efficiency labels.第十九条 国家质检总局和国家发展改革委依据各自职责，对列入目录的产品进行检查，核实能源效率标识信息。（相关资料:部门规章1篇）Article 20 The manufacturer, seller o
38、r importer of a product listed into the “Catalogue” shall accept supervision and inspections.第二十条 列入目录的产品的生产者、销售者和进口商应当接受监督检查。Article 21 Any entity or individual may expose the acts violating these Measures to the local energy conservation administrative department or the local quality inspection de
39、partment. The local energy conservation administrative department or the local quality inspection department shall investigate and settle the matter in time, and keep confidential for the exposer.第二十一条 任何单位和个人对违反本办法的行为，可以向地方节能管理部门、地方质检部门举报。地方节能管理部门、地方质检部门应当及时调查处理，并为举报人保密。Chapter IV Penalty Provision
40、s第四章 罚则Article 22 The local energy conservation administrative department and the local quality inspection department shall, in accordance with the relevant provisions of the “Law of the Peoples Republic of China on Energy Conservation”, and within the scope of their respective duties, take charge o
41、f penalizing the acts violating these Measures.第二十二条 地方节能管理部门、地方质检部门依据中华人民共和国节约能源法的有关规定，在各自的职责范围内负责对违反本办法规定的行为进行处罚。（相关资料:部门规章1篇）Article 23 Where any manufacturer or importer violates these Measures by failing to indicate a uniform energy efficiency label which ought to be indicated, it shall be orde
42、red by the local energy conservation administrative department or the local quality inspection department to make a correction within a time limit, and shall be circularized if it fails to make a correction with the time limit.第二十三条 违反本办法规定，生产者或进口商应当标注统一的能源效率标识而未标注的，由地方节能管理部门或者地方质检部门责令限期改正，逾期未改正的予以通
43、报。（相关资料:地方法规1篇）Article 24 Whoever violates these Measures and is under any of the following circumstances shall be ordered by the local energy conservation administrative department or the local quality inspection department to make a correction within a time limit and to stop using the energy effic
44、iency label; if the circumstance is severe, it/he shall be fined up to 10,000 Yuan by the local quality inspection department:(1) It/he fails to apply for archival filing of the energy efficiency label, or fails to go through the modification procedures which ought to be gone through; or(2) The spec
45、imen or specifications of the energy efficiency label it/he uses do not meet the prescribed requirements.第二十四条 违反本办法规定，有下列情形之一的，由地方节能管理部门或者地方质检部门责令限期改正和停止使用能源效率标识；情节严重的，由地方质检部门处1万元以下罚款：（一）未办理能源效率标识备案的，或者应当办理变更手续而未办理的；（二）使用的能源效率标识的样式和规格不符合规定要求的。（相关资料:地方法规2篇）Article 25 Whoever forges, imitates or conc
46、eals an energy efficiency label or makes use of an energy efficiency label to make false publicity or to mislead consumers, shall be penalized by the local quality inspection department in accordance with the “Law of the Peoples Republic of China on Energy Conservation”, the “Product Quality Law of
47、the Peoples Republic of China” and other laws and regulations.第二十五条 伪造、冒用、隐匿能源效率标识以及利用能源效率标识做虚假宣传、误导消费者的，由地方质检部门依照中华人民共和国节约能源法和中华人民共和国产品质量法以及其他法律法规的规定予以处罚。Chapter V Supplementary Provisions第五章 附则Article 26 The responsibility to interpret these Measures shall remain with the NDRC and the SAQSIQ.第二十六条 本办法由国家发展改革委和国家质检总局负责解释。Article 27 These Measures shall come into force on March 1, 2005.第二十七条 本办法自2005年3月1日起施行。 10 / 10
