6、ted in accordance with the Work Safety Law of the Peoples Republic of China and other relevant laws and administrative regulations. 第一条为了加强安全生产培训管理，规范安全生产培训秩序，保证安全生产培训质量，促进安全生产培训工作健康发展，根据中华人民共和国安全生产法和有关法律、行政法规的规定，制定本办法。Article 2 These Measures shall apply to the work safety training activities (here
7、inafter referred to as “safety training”) of safety training agencies and production and operation entities and the safety training supervision and administration by work safety administrative departments, coal mine safety supervisory authorities, and coal mine safety training departments of local p
8、eoples governments. 第二条安全培训机构、生产经营单位从事安全生产培训（以下简称安全培训）活动以及安全生产监督管理部门、煤矿安全监察机构、地方人民政府负责煤矿安全培训的部门对安全培训工作实施监督管理，适用本办法。Article 3 For the purposes of these Measures, “safety training” means the educational and training activities that aim to improve the safety quality of safety regulation and supervision
9、 personnel, employees of entities engaged in production and other operations, and personnel working in relation to work safety.The “safety regulation and supervision personnel” as mentioned in the preceding paragraph means the work safety regulators and coal mine safety supervisors engaged in safety
10、 regulation, supervision and law enforcement of the work safety administrative departments of the peoples governments at and above the county level and the coal mine safety supervisory authorities at all levels. The “employees of entities engaged in production and other operations” means the primary
11、 persons in charge, work safety management personnel, special operations personnel, and other employees of entities engaged in production and other operations. The “personnel working in relation to work safety” means the teachers engaged in safety education and training, registration staff of hazard
12、ous chemical registration institutions, persons engaged in safety evaluation, consulting, testing and inspection, certified safety engineers, and work safety emergency personnel, among others. 第三条本办法所称安全培训是指以提高安全监管监察人员、生产经营单位从业人员和从事安全生产工作的相关人员的安全素质为目的的教育培训活动。前款所称安全监管监察人员是指县级以上各级人民政府安全生产监督管理部门、各级煤矿安全
13、监察机构从事安全监管监察、行政执法的安全生产监管人员和煤矿安全监察人员；生产经营单位从业人员是指生产经营单位主要负责人、安全生产管理人员、特种作业人员及其他从业人员；从事安全生产工作的相关人员是指从事安全教育培训工作的教师、危险化学品登记机构的登记人员和承担安全评价、咨询、检测、检验的人员及注册安全工程师、安全生产应急救援人员等。Article 4 The principle of “unified planning, centralized management, implementation by level, categorized guidance, and separation of
14、 teaching from examinations” shall be followed in safety training work.The State Administration of Work Safety (“SAWS”) shall guide the national safety training work and conduct supervision an administration of safety training across the country in accordance with law.The State Administration of Coa
15、l Mine Safety (“SACMS”) shall guide the national coal mine safety training work and conduct supervision and administration of coal mine safety training across the country in accordance with law.The National Workplace Emergency Management Center shall guide the national training on work safety emerge
16、ncy rescue.The work safety administrative departments of the local peoples governments at and above the county level shall conduct supervision and administration of safety training within their respective administrative regions.The coal mine safety training departments of the peoples governments of
17、provinces, autonomous regions, and municipalities directly under the Central Government and the coal mine safety supervisory authorities at the provincial level (hereinafter collectively referred to as “provincial coal mine safety training regulatory authorities”) shall, within their respective func
18、tions, conduct supervision and administration of coal mine safety training within their respective jurisdictions. 第四条安全培训工作实行统一规划、归口管理、分级实施、分类指导、教考分离的原则。国家安全生产监督管理总局（以下简称国家安全监管总局）指导全国安全培训工作，依法对全国的安全培训工作实施监督管理。国家煤矿安全监察局（以下简称国家煤矿安监局）指导全国煤矿安全培训工作，依法对全国煤矿安全培训工作实施监督管理。国家安全生产应急救援指挥中心指导全国安全生产应急救援培训工作。县级以上地
19、方各级人民政府安全生产监督管理部门依法对本行政区域内的安全培训工作实施监督管理。省、自治区、直辖市人民政府负责煤矿安全培训的部门、省级煤矿安全监察机构（以下统称省级煤矿安全培训监管机构）按照各自工作职责，依法对所辖区域煤矿安全培训工作实施监督管理。Chapter II Safety Training Agencies第二章安全培训机构Article 5 To conduct safety training activities, safety training agencies must obtain corresponding qualification certificates. Qual
20、ification certificates are classified into three grades.The SAWS shall have the power to approve and issue Grade I qualification certificates, and the work safety administrative departments of the peoples governments of provinces, autonomous regions, and municipalities directly under the Central Gov
21、ernment (hereinafter referred to as the “provincial work safety administrative departments”) shall have the power to approve and issue Grade II and Grade III qualification certificates. For provinces, autonomous regions, and municipalities directly under the Central Government where coal mine safety
22、 supervisory authorities are established, the provincial coal mine safety supervisory authorities shall have the power to approve and issue Grade II and Grade III qualification certificates to training agencies engaged in coal mine safety training activities within their respective jurisdictions. 第五
23、条安全培训机构从事安全培训活动，必须取得相应的资质证书。资质证书分三个等级。一级资质证书，由国家安全监管总局审批、颁发；二级、三级资质证书，由省、自治区、直辖市人民政府安全生产监督管理部门（以下简称省级安全生产监督管理部门）审批、颁发。设立煤矿安全监察机构的省、自治区、直辖市，由省级煤矿安全监察机构负责所辖区域内从事煤矿安全培训活动的培训机构二级、三级资质证书的审批、颁发。Article 6 Safety training agencies with Grade I qualification certificates may provide training for the work saf
24、ety regulators and coal mine safety supervisors of the work safety administrative departments and coal mine safety supervisory authorities at and above the provincial level, the primary persons in charge and work safety management personnel of the parent companies, general factories or group compani
25、es of central enterprises, and the teachers of safety training agencies.Safety training agencies with Grade II qualification certificates may provide training for the work safety regulators of the work safety administrative departments of the peoples governments of districted cities and counties (he
26、reinafter referred to as the “work safety administrative departments of cities and counties”), the primary persons in charge and work safety management personnel of the provincial entities engaged in production and other operations and the branch and subsidiary companies and subordinate entities of
27、central enterprises, the primary persons in charge of entities producing, trading and storing dangerous goods and mine enterprises, the registration staff of hazardous chemical registration institutions, the persons engaged in safety evaluation, consulting, testing and inspection, the certified safe
28、ty engineers, and the teachers of Grade III safety training agencies. Safety training agencies with Grade III qualification certificates may provide training for the employees of entities engaged in production and other operations other than the primary persons in charge and work safety management p
29、ersonnel of central enterprises and provincial entities engaged in production and other operations and the primary persons in charge of entities producing, trading and storing dangerous goods and mine enterprises. Safety training agencies at a higher level may provide training in lieu of safety trai
30、ning agencies at a lower level. Safety training agencies which meet the conditions set out in Article 10 of these Measures may provide training for special operations personnel in the corresponding operation specialty. 第六条取得一级资质证书的安全培训机构，可以承担省级以上安全生产监督管理部门、煤矿安全监察机构的安全生产监管人员、煤矿安全监察人员，中央企业的总公司、总厂或者集团公
31、司的主要负责人和安全生产管理人员，以及安全培训机构教师的培训工作。取得二级资质证书的安全培训机构，可以承担设区的市、县级人民政府安全生产监督管理部门（以下简称市级、县级安全生产监督管理部门）的安全生产监管人员，省属生产经营单位和中央企业的分公司、子公司及其所属单位主要负责人和安全生产管理人员，危险物品的生产、经营、储存单位和矿山企业的主要负责人，危险化学品登记机构的登记人员，承担安全评价、咨询、检测、检验工作的人员，以及注册安全工程师和三级安全培训机构教师的培训工作。取得三级资质证书的安全培训机构，可以承担除中央企业、省属生产经营单位的主要负责人、安全生产管理人员以及危险物品的生产、经营、储存
32、单位和矿山企业的主要负责人以外的生产经营单位从业人员的培训工作。上一级安全培训机构可以承担下一级安全培训机构的培训工作。安全培训机构具备本办法第十条规定条件的，可以承担相应作业类别特种作业人员的培训工作。Article 7 To apply for a Grade I qualification certificate, a safety training agency shall meet the following conditions:(1) be able to assume legal liability independently or as authorized and have
33、 five million yuan or more in registered capital or establishment funds;(2) have full-time management personnel;(3) have adequate and effective bylaws, management regulations, and working rules; (4) have 15 or more full-time or part-time teachers with a university diploma at or above the undergradua
34、te level, among whom there are, at a minimum, 10 full-time teachers who have senior or above professional titles and have passed the examinations organized by the SAWS, and have, at a minimum, five full-time teachers who have obtained the practicing qualification for certified safety engineers; (5)
35、have fixed, independent and relatively centralized teaching and living facilities that are able to meet the requirements for training 100 or more persons during the same term, of which the usable floor area of special classrooms is 150 square meters or more; and (6) other conditions as required for
36、safety training. 第七条安全培训机构申请一级资质证书，应当具备下列条件：（一）能够独立或者经授权承担法律责任，注册资金或者开办费500万元以上；（二）有专职的管理人员；（三）有健全的机构章程、管理制度、工作规则；（四）有15名以上具有本科以上学历的专职或者兼职教师，其中至少有10名具有高级以上职称并且经国家安全监管总局考核合格的专职教师，专职教师中至少有5名取得注册安全工程师执业资格；（五）有固定、独立和相对集中并且能够满足同期100人以上规模培训需要的教学及生活设施，其中专用教室使用面积150平方米以上；（六）安全培训需要的其他条件。Article 8 To apply fo
37、r a Grade II qualification certificate, a safety training agency shall meet the following conditions:(1) be able to assume legal liability independently or as authorized and have three million yuan or more in registered capital or establishment funds; (2) have full-time management personnel;(3) have
38、 adequate and effective bylaws, management regulations, and working rules; (4) have 10 or more full-time or part-time teachers with a university diploma at or above the undergraduate level, among whom there are, at a minimum, six full-time teachers who have medium or above professional titles and ha
39、ve passed the examinations organized by the provincial work safety administrative departments or provincial coal mine safety supervisory authorities, and have, at a minimum, three full-time teachers who have obtained the practicing qualification for certified safety engineers; (5) have fixed, indepe
40、ndent and relatively centralized teaching and living facilities that are able to meet the requirements for training 80 or more persons during the same term, of which the usable floor area of special classrooms is 120 square meters or more; and (6) other conditions as required for safety training. 第八
41、条安全培训机构申请二级资质证书，应当具备下列条件：（一）能够独立或者经授权承担法律责任，注册资金或者开办费300万元以上；（二）有专职的管理人员；（三）有健全的机构章程、管理制度、工作规则；（四）有10名以上具有本科以上学历的专职或者兼职教师，其中至少有6名具有中级以上职称并且经省级安全生产监督管理部门或者省级煤矿安全监察机构考核合格的专职教师，专职教师中至少有3名取得注册安全工程师执业资格；（五）有固定、独立和相对集中并且能够满足同期80人以上规模培训需要的教学及生活设施，其中专用教室使用面积120平方米以上；（六）安全培训需要的其他条件。Article 9 To apply for a G
42、rade III qualification certificate, a safety training agency shall meet the following conditions:(1) be able to assume legal liability independently or as authorized and have one million yuan or more in registered capital or establishment funds; (2) have full-time management personnel;(3) have adequ
43、ate and effective bylaws, management regulations, and working rules; (4) have eight or more full-time or part-time teachers with a university diploma at or above the undergraduate level, among whom there are, at a minimum, five full-time teachers who have medium or above professional titles and have
44、 passed the examinations organized by the provincial work safety administrative departments or provincial coal mine safety supervisory authorities, and have, at a minimum, two full-time teachers who have obtained the practicing qualification for certified safety engineers; (5) have fixed, independen
45、t and relatively centralized teaching and living facilities that are able to meet the requirements for training 60 or more persons during the same term, of which the usable floor area of special classrooms is 100 square meters or more; and (6) other conditions as required for safety training. 第九条安全培
46、训机构申请三级资质证书，应当具备下列条件：（一）能够独立或者经授权承担法律责任，注册资金或者开办费100万元以上；（二）有专职的管理人员；（三）有健全的机构章程、管理制度、工作规则；（四）有8名以上具有本科以上学历的专职或者兼职教师，其中至少有5名具有中级以上职称并且经省级安全生产监督管理部门或者省级煤矿安全监察机构考核合格的专职教师，专职教师中至少有2名取得注册安全工程师执业资格；（五）有能够满足同期60人以上规模培训需要的教学及生活设施，其中专用教室使用面积100平方米以上；（六）安全培训需要的其他条件。Article 10 To provide safety technical trai
47、ning for special operations personnel, a safety training agency shall meet the following conditions, in addition to those set out in Article 7, 8 or 9 of these Measures:(1) have, at a minimum, two full-time teachers with an educational background of junior college or above in the corresponding speci
48、alty for each operation specialty, among whom teachers teaching practical operations shall have professional technician certificates or above in the corresponding specialty; and(2) have the practical operation conditions for the corresponding operation specialty. 第十条安全培训机构申请承担特种作业人员安全技术培训的，除符合本办法第七、八、九条规定的条件外，还应当具备下列条件：（一）每个作业类别不得少于2名专科以上学历、
