6、d Control Law of the Peoples Republic of China(hereinafter referred to as the “Water Pollution Prevention and Control Law”) for purposes of urging the pollutant-discharging entities to treat the existing pollution sources within a prescribed time limit, rectifying the mismatch between the facilities

7、 for water pollutant treatment and treatment requirements, and promoting the project discharge reduction of water pollutants. 第一条 【立法目的】为督促排污单位在限期内治理现有污染源,纠正水污染物处理设施与处理需求不匹配的状况,推动水污染物工程减排,根据中华人民共和国水污染防治法(以下简称水污染防治法),制定本办法。Article 2 (Scope of application) Where a pollution source of any pollutant-dis

8、charging entity falls under any of the following circumstances, the decision on treatment within a prescribed time limit shall be adopted: (1) the water pollutants discharged exceed the state or local standard for discharge of water pollutants (hereinafter referred to as “exceeding the standard”); o

9、r(2) the discharged major water pollutants of which the total discharge volume is subject to reduction and control as determined by the State Council or the peoples government of a province, autonomous region or municipality directly under the Central Government exceed the indicator for the control

10、of total discharge volume (hereinafter referred to as “exceeding the total discharge volume”).第二条 【适用范围】排污单位的污染源有下列情形之一的,适用限期治理:(一)排放水污染物超过国家或者地方规定的水污染物排放标准的(本办法以下简称“超标”);(二)排放国务院或者省、自治区、直辖市人民政府确定实施总量削减和控制的重点水污染物,超过总量控制指标的(本办法以下简称“超总量”)。Article 3 (Inapplicable circumstances) Where the water pollutan

11、ts discharged exceed the standard or the total discharge volume, the special provisions shall be applicable instead of the provisions on treatment within a prescribed time limit provided that the issue falls under any of the following circumstances for which there are special provisions in the relev

12、ant articles of laws or regulations:(1) Whoever puts into production or use the principal part of a construction project of which the facilities for water pollution prevention and control have not been finished yet, have not been checked for acceptance or fail to pass the acceptance check shall be p

13、unished in accordance with Article 71 of the Water Pollution Prevention and Control Law.(2) Whoever puts into trial production a construction project, but fails to put into trial operation the supporting facilities for water pollution prevention and control simultaneously with the principal part of

14、the project shall be punished in accordance with Article 26 of the Regulation on the Administration of Environmental Protection of Construction Projects.(3) Whoever uses facilities for water pollutant treatment abnormally or dismantles or leaves unused such facilities without the approval of the adm

15、inistrative department of environmental protection shall be punished in accordance with Article 73 of the Water Pollution Prevention and Control Law.(4) Whoever, in violation of Law, uses any equipment or technique which causes serious water pollution and is compulsorily eliminated by the state shal

16、l be punished in accordance with Article 77 of the Water Pollution Prevention and Control Lawif the circumstance is serious. 第三条 【不适用情形】排放水污染物超标或者超总量,但有下列情形之一,法律法规相关条款另有特别规定的,适用特别规定,不适用限期治理:(一)建设项目的水污染防治设施未建成、未经验收或者验收不合格,主体工程即投入生产或者使用的,根据水污染防治法第七十一条处罚。(二)建设项目投入试生产,其配套建设的水污染防治设施未与主体工程同时投入试运行的,根据建设项目环

17、境保护管理条例第二十六条处罚。(三)不正常使用水污染物处理设施,或者未经环境保护行政主管部门批准拆除、闲置水污染物处理设施的,根据水污染防治法第七十三条处罚。(四)违法采用国家强制淘汰的造成严重水污染的设备或者工艺,情节严重的,根据水污染防治法第七十七条处罚。(相关资料:部门规章1篇)Article 4 (Hierarchical jurisdiction) The decision on treatment within a prescribed time limit against an enterprise under key monitoring of the state shall

18、be made by the administrative department of environmental protection of a province, autonomous region, or municipality directly under the Central Government and shall be filed with the Ministry of Environmental Protection. The decision on treatment within a prescribed time limit against an enterpris

19、e under key monitoring of a province shall be made by the administrative department of environmental protection at the level of a districted city where the enterprise is located, and shall be filed with the administrative department of environmental protection of the province, autonomous region or m

20、unicipality directly under the Central Government. The decision on treatment within a prescribed time limit against any other pollutant-discharging entity shall be made by the administrative department of environmental protection at the level of a districted city or a county where the pollution sour

21、ce is located. 第四条 【级别管辖】国家重点监控企业的限期治理,由省、自治区、直辖市环境保护行政主管部门决定,报环境保护部备案。省级重点监控企业的限期治理,由所在地设区的市级环境保护行政主管部门决定,报省、自治区、直辖市环境保护行政主管部门备案。其他排污单位的限期治理,由污染源所在地设区的市级或者县级环境保护行政主管部门决定。Article 5 (Special jurisdiction) Where the administrative department of environmental protection at a lower level has any difficu

22、lty in making the decision on treatment within a prescribed time limit, it may require the administrative department of environmental protection at the next higher level to decide the treatment within a prescribed time limit. Where the administrative department of environmental protection at a lower

23、 level fails to make a decision on treatment within a prescribed time limit against a pollutant-discharging entity that should be subject to treatment within a prescribed time limit in accordance with law, the administrative department of environmental protection at the higher level shall order it t

24、o make a decision on treatment within a prescribed time limit under law, or directly make such decision. Where a pollutant-discharging entity discharges water pollutants by exceeding the standard or the total discharge volume and causes especially serious social impacts or falls under any other espe

25、cially serious circumstance, the Ministry of Environmental Protection may directly make a decision on treatment within a prescribed time limit. The administrative departments of environmental protection at higher and lower levels shall not make decisions on treatment within a prescribed time limit r

26、epeatedly against the same violation by the same pollution source.第五条 【特殊管辖】下级环境保护行政主管部门实施限期治理有困难的,可以报请上一级环境保护行政主管部门决定限期治理。下级环境保护行政主管部门对依法应予限期治理的排污单位不作出限期治理决定的,上级环境保护行政主管部门应当责成下级环境保护行政主管部门依法决定限期治理,或者直接决定限期治理。排污单位排放水污染物超标或者超总量造成的社会影响特别重大,或者有其他特别严重情形的,环境保护部可以直接决定限期治理。上下级环境保护行政主管部门,对同一污染源的同一违法行为,不得重复下达

27、限期治理决定。Article 6 (Time limit) The administrative department of environmental protection shall, in accordance with the actual needs for completing the task of treatment within a prescribed time limit, reasonably determine the time limit for the treatment. The time limit for the treatment shall not ex

28、ceed one year at the maximum. Except the case that the pollutant-discharging entity subject to treatment within a prescribed time limit fails to complete the treatment task on time fully due to force majeure. The administrative department of environmental protection shall not, by means of repeatedly

29、 making decisions on treatment within a prescribed time limit, etc., extend the time limit for the treatment in any disguised form. 第六条 【期限】环境保护行政主管部门应当根据完成限期治理任务的实际需要,合理确定限期治理期限。限期治理期限最长不得超过1年。但完全由于不可抗力的原因,导致被限期治理的排污单位不能按期完成治理任务的除外。环境保护行政主管部门不得通过重复下达限期治理决定等方式,变相延长限期治理期限。Article 7 (Information discl

30、osure) The administrative department of environmental protection shall disclose the following information by newspapers, portal websites and other means accessible to the public: (1) names of the pollutant-discharging entities that are ordered to make treatment within a prescribed time limit, Decisi

31、ons on Treatment within a Prescribed Time Limit, the plans of pollutant-discharging entities for making treatment within a prescribed time limit and other relevant documents;(2) names of the pollutant-discharging entities which are released from decisions on treatment within a prescribed time limit

32、in accordance with law after they complete the treatment task within the prescribed time limit; and(3) names of pollutant-discharging entities which are ordered to close down in accordance with law for their failure to complete the treatment task within the prescribed time limit. The administrative

33、department of environmental protection shall not disclose the governmental information involving state secrets, trade secrets and personal privacy. 第七条 【信息公开】环境保护行政主管部门应当通过报刊、门户网站等便于公众知晓的方式,将下列信息向社会公开:(一)被责令限期治理的排污单位名称、限期治理决定书、排污单位的限期治理方案等相关文件;(二)完成限期治理任务后,被依法解除限期治理的排污单位名称;(三)因逾期未完成限期治理任务,被依法责令关闭的排污

34、单位名称。环境保护行政主管部门不得公开涉及国家秘密、商业秘密、个人隐私的政府信息。Chapter II Procedures for Decision Making第二章 决定程序Article 8 (Putting cases on file for investigation) When conducting on-site inspection, the administrative department of environmental protection may, on the basis of the real-time on-the-spot sampling or monit

35、oring results conducted by its staff members, determine whether the water pollutants discharged by the pollution source exceed the standard or the total discharge volume. For the pollution source which discharged water pollutants by exceeding the standard or the total discharge volume as confirmed t

36、hrough on-site inspection, the administrative department of environmental protection shall timely analyze the reasons. If, upon analysis and determination, the fact of exceeding the standard or the total discharge volume may be caused by the mismatch between the facilities for water pollutant treatm

37、ent and the treatment requirements, the administrative department of environmental protection shall, in accordance with the relevant provisions of these Measures on the jurisdiction over treatment within a prescribed time limit, put the case on file for investigation and determine the institution to

38、 be responsible for putting the case on file for investigation. 第八条 【立案调查】环境保护行政主管部门现场检查时,可以凭环境保护行政主管部门工作人员现场即时采样或者监测的结果,判定污染源排放水污染物是否超标或者超总量。对经现场检查判定排放水污染物超标或者超总量的污染源,环境保护行政主管部门应当及时分析原因。经分析判断超标或者超总量可能是由水污染物处理设施与处理需求不匹配原因造成的,环境保护行政主管部门应当按照本办法有关限期治理管辖权限的规定立案调查,并确定负责立案调查的机构。Article 9 (Steps of determi

39、nation) For a pollutant-discharging enterprise which has been put on file for investigation, the institution taking charge of case filing and investigation shall, through the following steps, determine whether the fact that the water pollutants discharged exceed the standard or the total discharge v

40、olume is caused by the mismatch between the facilities for water pollutant treatment and the treatment requirements, and report to the administrative department of environmental protection:(1) on-site monitoring: organizing an environmental monitoring institution to monitor the water pollutants disc

41、harged by the pollution source in the production cycle in accordance with the sampling frequency prescribed by the standards for monitoring pollution sources; and(2) technology assessment: organizing production experts in the industry, technical experts in pollutant treatment and enterprise represen

42、tatives to analyze and assess whether the facilities of the pollutant-discharge entity for water pollutant treatment match the treatment requirements thereof by means of technical process analysis, material balance, etc. 第九条 【判断步骤】对已被立案调查的排污单位,负责立案调查的机构应当通过以下步骤,对排放水污染物超标或者超总量是否因水污染物处理设施与处理需求不匹配所致作出判

43、断,并报环境保护行政主管部门:(一)现场监测:组织环境监测机构按照污染源监测规范规定的采样频次,对污染源在生产周期内所排水污染物进行监测;(二)技术评估:组织行业生产专家、污染物处理技术专家和企业代表,采用工艺流程分析、物料衡算等方法,对排污单位水污染物处理设施与处理需求是否匹配进行分析评估。Article 10 (Advance notice) Where the administrative department of environmental protection determines that the mismatch between the facilities for water

44、 pollutant treatment and the treatment requirements causes the discharged water pollutants exceeding the standard or the total discharge volume on the basis of the monitoring data and results of technology assessment, it shall issue an Advance Notice on Treatment within a Prescribed Time Limit to th

45、e pollutant-discharging entity. 第十条 【事先告知】环境保护行政主管部门根据监测数据和技术评估结果,判断水污染物处理设施与处理需求不匹配导致排放水污染物超标或者超总量的,应当向排污单位发出限期治理事先告知书。Article 11 (Content of the notice) An Advance Notice on Treatment within a Prescribed Time Limit shall specify the following:(1) the name of the pollutant-discharging entity;(2) fa

46、cts and evidence that the mismatch between the facilities for water pollutant treatment and the treatment requirements causes the discharged water pollutants exceeding the standard or the total discharge volume; (3) the decision on treatment within a prescribed time limit to be made and the legal ba

47、sis;(4) legal consequences in case of failure to complete the treatment task within the prescribed time limit; and(5) the rights of the pollutant-discharging entity to make a statement and argument and apply for a hearing. Where the administrative department of environmental protection deems necessa

48、ry, it may arrange talks with the legal representative or any other chief person-in-charge of the pollutant-discharging entity about issues on treatment of the pollution source within a prescribed time limit. 第十一条 【告知内容】限期治理事先告知书应当载明以下内容:(一)排污单位名称;(二)水污染物处理设施与处理需求不匹配导致排放水污染物超标或者超总量的事实和证据;(三)拟作出的限期治理决定和法律依据;(四)未完成限期治理任务的法律后果;(五)排污单位陈述、申辩和申请听证的权利。环境保护行政主管部门认为必要时,可以就污染源限期治理事项,约谈排污单位的法定代表人或者其他主要负
