2、en and standardize the management system of the Companies, maintain the good work environment & work disciplines and encourage the creativity and innovations of the employees, the mental reward and material reward will be given to the employee who makes contributions or excellence performances, whic
3、h will be subject to how much the contribution that the employee makes and how good the employee performs. Article 2 The R.P. Policy will be bound into a book and issued to every employee, and is attached as the annex of the Labor Contract, which has the equal effect to the Labor Contract. Article 3
4、 This Policy applies to all the employees of Liebherr Machinery (Xuzhou) Co., Ltd. and Xuzhou Liebherr Concrete Machinery Co., Ltd. (hereinafter shortly referred as “Employees” and “CLX/XLC” or “Companies”), dispatched personnel and other temporary workers of CLX/XLC, etc. Valid in CLX &XLC Page 2 o
5、f 22 Edition: 0012008 Rewards & Punishment Policy Chapter 2 Rewards Regulation Article 4 Rewards granted to Employees include Praise, Award, Reward, Special Award, etc; 4.1 Praise: In the way of oral praise or written praise and to be raised by his/ her direct superior and approved by Dept. manager.
6、 4.2 Award: RMB 300 to RMB 800 in cash or souvenir with the same value, which will be recommended by his/her direct Superior and then approved by Dept. manager. 4.3 Reward: No more than RMB 2000 in cash or souvenirs with the same value, which will be recommended by Dept. manager in the written way a
7、nd then approved by GM or Vice GM, meanwhile with a Reward Certificate signed by (Vice) GM. 4.4 Special Award: Bonus of a certain amount of money and the title-granted honor, subject to the work performances and contributions of the employee, which will be recommended by Dept. manager, filed by H.R.
8、 Dept. and then approved by the (Vice) GM. Article 5 The Companies will grant “Praise” title to the employee who makes one of the following behaviors: 5.1 Having good behaviors, being honest and reliable, work carefully and seriously, with good performance in accomplishment of tasks; 5.2 Returning m
9、oney (things) found and having outstanding behaviors; 5.3 Participating actively into Companies activity with excellent performance; 5.4 Exerting the model role and achieving honors to the Companies; 5.5 Other contributions. 10、 Article 6 The Companies will grant “Award” title to the employee who makes one of the following behaviors: 6.1 Great improvements of technologies or management system that brings great profit to the Companies; 6.2 Remarkable effects on saving of materials or utilizing of scraps; 6.3 Conduct of dash
11、ing ahead bravely regardless of oneself when encountering accidents or disasters that results in reducing damages of the Companies; 6.4 Maintaining the interests of the Companies and preventing from serious accidents to the Companies; 6.5 Other similar great contributions; 6.6 Being praised for over
12、 3 times with remarkable contributions; Article 7 The Companies will grant “Reward” title to the employee who makes one of the following behaviors: 7.1 Conduct of dashing ahead regardless of oneself when encountering serious accidents or disasters that results in avoiding great losses of the Compani
13、es; 7.2 Providing services for customers warmly and often getting written praises from customers; achieving high credit and honor for the Companies with outstanding performances; 7.3 Making great improvements in terms of work efficiency and quality of products through technical innovation, work proc
14、edure simplification and easy operations 7.4 Other similar contributions. Article 8 The Companies will grant “Special Award” title to the employee who makes one of the following behaviors: 8.1 Invention and remarkable contributions that result in great reduce of costs and fast increase of profits fo

Valid in CLX &XLC Page 5 of 22 Edition: 0012008 Rewards & Punishment Policy Chapter 3 Disciplinary Punishment Regulation Article 9 This Policy is the basis (guidance) provided for the managers when they d
17、eal with the issue as to the employees work performances or their violation behaviors against work disciplines. This regulation is to be fair and consistent to all employees in case of their violations against work disciplines; it is aimed at correcting the violating discipline behaviors and promoti
18、ng the work attitude of the employees, so as to improve the work performances of the employees. Article 10 As for the violations against the management regulations and labor disciplines of the Companies, subject to the seriousness of the case, the punishment to be applied is divided into: ? warning,
19、 ? economic penalty, ? reduction in salary and work-position, and ? rescission of labor contract. Article 11 Discipline Treatment Procedure and Authorization Limit 11.1 Warning and Economic Penalty: A warning or an economic penalty shall be put forward by the employee superior or section chief in th
20、e written way, and then implemented after it is approved by the department manager, and finally filed by the HR Dept. Warning is divided into oral warning and written warning according to the seriousness of the case. The one-time-lump economic penalty shall be no more than 20% of the monthly salary
21、of the employee. 11.2 Reduction in Salary and Work-position: It shall be put forward by the Valid in CLX &XLC Page 6 of 22 Edition: 0012008 Rewards & Punishment Policy employees direct manager in the written way, approved by the department principal (indicating the management leaders of Commercial/A
22、dministrative Dept, Sales Dept. and Production Dept.), and implemented by HR Dept. 11.3 Rescission of Labor Contract: It shall be put forward by the Dept. manager in the written way, inquired with the suggestions of Labor Union and implemented after it is approved by the GM (Vice GM). In case that t
23、he Labor Union holds different opinions, the Companies management shall consider the suggestions of the Labor Union and then inform the settlement result to the Labor Union in the written way. 11.4 Before being issued to the employee related, the written disciplinary punishment document shall state
24、clearly the poor performance and disciplinary violation behaviors; after receiving such written notice hereof, the employee shall sign it for confirmation. Article 12 The Companies will apply “Warning” punishment to the employee who has one of the following behaviors: 12.1 Breach of management regul
25、ations of the Companies; 12.2 Disorder conducts in the Companies (or in the Companies shuttle-bus) (such like huddling, shouting and abusing others, etc.); 12.3 Refusing to have physical checks which are required by the Companies; 12.4 Being dressed improperly in the Companies; wearing slippers and
26、naked back; not wearing LIEBHERR uniform and labor protection appliances; or sticking adhesive tapes or other things onto the LIEBHERR uniforms and the labor protection shoes; 12. 5 Behaving badly outside the Companies with wearing LIEBHERR-logo, which harms the Companies social image; 12.6 Throwing
27、 things randomly in the public area within the Companies; not pouring the residual meal into the rubbish bin as required and not keeping the work environment clean and tidy; Valid in CLX &XLC Page 7 of 22 Edition: 0012008 Rewards & Punishment Policy 12.7 Disturbing others during working time; 12.8 B
28、eing impolite to suppliers, customers or other employees; 12.9 Breach of the discipline of check on work-attendance by failing to read work-attendance-card as required; 12.10 Failing to go through Leave Application Procedures when making work-leaves; 12.11 Absence on important activities held by the
29、 Companies, such as trainings or meetings, etc. 12.12 Being complained by customers for his/her personal reasons which are proved to be true after investigations; 12.13 Failing to deliver down (declare) the documents timely which are issued by the Companies; failing to manage his/her subordinate peo
30、ple; failing to report to the upper levels step by step the violations and damages of public properties by the subordinates. 12.14 Failing to turn off the power supply, water supply and air-conditioners, etc. according to the relevant regulations of the Companies and therefore causing energy waste;
31、12.15 Disobeying the Companies security guard management when entering into or exiting from the Companies; 12.16 Other behaviors that break rules and regulations of the Companies similar with the aforesaid. Article 13 The Companies will apply “Economic Penalty” punishment to the employee who has one
32、 of the following behaviors: 13.1 Conducting once again any one of the behaviors mentioned in Article 12 within one year; 13.2 Not being on duty during work time as regulated neither informing it timely to the superior; 13.3 Coming late and leaving early; 13.4 Two or less consecutive days of absence

34、 working time; 13.7 Operating or driving company trucks, machines or equipments without permission and profession-certificates; 13.8 Gossiping, lying down for rest, sleeping, chatting on the line, not being on duty position, chasing , playing cards and chess, watching TV, playing computer games and
35、mobile phones and slacking off at works during working hours; 13.9 Producing private articles or inciting others to produce private articles at the work area; 13.10 Destroying public properties; 13.11 Spitting on the floor or wall, littering rubbish, and smoking at the no-smoking area; 13.12 Making
36、rumors, abusing other employees, conducting fights and other immoral behaviors; 13.13 Contradicting the superiors or management persons, disobeying the reasonable directions and supervisions, being inconsistent on words and deeds and slacking off at works; 13.14 Damage of equipments and materials or
37、 hurts to others due to personal negligence. 13.15 Not carrying out the orders given by the superior with reasonable reasons; 13.16 Loss or serious harm to the Companies resulted from losing ones tools, keys and archive documents; 13.17 Entering the forbidden area without prior permission, occupying
38、 the property or checking the documents in the forbidden area of the Companies; 13.18 Inciting or agitating intentionally and hostilely to hurt the personal body-health of the suppliers or the employees; Valid in CLX &XLC Page 9 of 22 Edition: 0012008 Rewards & Punishment Policy 13.19 Indulging, inc
39、iting or participating in any kinds of gambling, lottery, or other speculative activities; 13.20 Pasting on or tearing the information papers from the Notice Board of the Companies without prior permission. 13.21 Disobeying the Companies safety rules and regulations, or not reporting the persons hur
40、t or accidents to the superior immediately; 13.22 Drinking wine during working time and therefore causing adverse impact to others work; 13.23 Damage to the Companies equipments and materials or hurt to others with slight consequence due to ones personal negligence; 13.24 Other behaviors which shall
41、 be fined according to other regulations of the Companies; 13.25 Other situations that break rules and regulations of the Companies similar with the aforesaid. Article 14 The Companies will apply “Reduction in Salary & Work-position” to the employee who has any one of the following situations: 14.1
42、Over 2 and less than 6 or 6 consecutive days of absence off work, or over 4 and less than 14 or 14 accumulated days of absence off work within one year; 14.2 Three times accumulated of violating disciplines within one year and without any corrections; 14.3 Bodys harm to the employees or customers or
43、 loss and damage of the properties of the Companies, the suppliers, the customers and the employees as a result of duty default or the carelessness of the employee; 14.4 Bodys harm or property losses to the employees, the customers or the Companies due to intentional negligence to Companies safety r
44、egulation or disobeying of any reasonable orders in terms of safety instruction; 14.5 Conduct of all dishonesties and deceits, including deceits for holidays or Valid in CLX &XLC Page 10 of 22 Edition: 0012008 Rewards & Punishment Policy cheats for leaves from illnesses and others not faithful to th
45、e Companies; 14.6 Conducts of briberies for work-position promotion or better work environment, etc.; 14.7 Receiving the presents (in property way or other type of interests) from the contractors, service suppliers or customers without prior permission of the GM; 14.8 Producing false medical certifi
46、cate or not immediately informing the infectious diseases or other serious diseases to the Dept. manager; 14.9 Providing false certificates, travel bills and other vouchers; 14.10 Doing part-time jobs in the same industry circle without any permission, as well as other part-times jobs which may affe
47、ct his/her normal work in the Companies; 14.11 Other situations that break rules and regulation of the Companies similar with the aforesaid. Article 15 After getting the consensus from the Labor Union, the Companies will apply “Rescission of Labor Contract” to the employee who has any one of the fol
48、lowing situations: 15.1 Conducting once again any one of the behaviors mentioned in Article 14 within one year; 15.2 Over 6 consecutive days of absence off work or over 14 accumulated days of absence off work within one year; 15.3 Stealing or pocketing the properties belonging to the Companies, the
49、suppliers, the customers or the colleagues; 15.4 Colluding with the suppliers, customers or other employees to fake the records and files of the Companies for money or other improper purposes. 15.5 Committing crimes and being investigated for the criminal responsibilities, subject to law regulation.
